Do I qualify for FMLA?

USPS is getting crazy with call ins and disciplinary action. I have missed 5 days in the last year, and I was written up for poor attendance. Migraines my main call in reason. I was diagnosed in 2011 but have come to the decision to cover my job. Opinion on the issue?

  1. Thanks so much for your question. It is important for you to research the vacation and sick leave benefits/policies offered specifically by your job as your employer can enforce its policies for vacation and sick leave even if the reason you’re seeking FMLA leave is unforeseeable. For instance, if your employer requires two weeks notice for vacation leave requests and you find out one day in advance you need to seek leave under FMLA, your employer does not have to let you use your vacation time to receive pay during that period. You may take the leave, but it would be unpaid.

    I'd recommend that you meet with your human resources person to ask them about their policies as that person should be in place to represent and help you just as much as the company.

    Lastly, when you're entering into a phase where you're missing work due to migraine (which is very common- migraine is the 7th leading cause of disability, after all), it can become important to strengthen your relationship with your migraine specialist so that doctor can help you document your migraine disease and support your reasons for having to be absent.

    1. FMLA paperwork was mail in 3 days before our flight, this was the annual leave approved back in December. The second request and disapproval was deliver while I had no knowledge of the further information was needed. They couldn't have any authority on that leave considering $1,200 was spent on tickets l
      In March.
