"Hi everyone! New here! I've had migraines for 4 years 5 months and 18 days! I'm connected to other social media sites regarding migraine sufferers and before today I used them as a way to learn as much as I could regarding medications and prevention. I had a serious traumatic brain injury so my migraines are different then some. Well anyway I'm here today to learn more about the legal side and I'm hoping someone has gone through this. I have provided fmla paperwork yearly to my employer with intermittent leave on it. I have provided multiple doctor proofs showing the need for the leave and have really lowered the amount of leave I've taken. Well I was out of the office for 2 days for a migraine and we all know migraines make it so you cant do much. After day one my employer asked for a doctor note and indicated she never approved my fmla which I gave her in april. So first question how long do they have to approve fmla? Second question I am within the 6 month period of submitting the paperwork and yet she asked for a doctors note. My doctor is an hour away and we all know not to drive when we are in a migraine. So I emailed my doctor asked for doctor note and called to make sure they understood what was going on. My doctor emailed back I dont understand I filled out fmla why are they asking me for this? And if I didnt go into the office she could just write a note saying I suffer headaches. So question 2 is can the employer ask for doctor notes everytime leave is taken for migraines? Are they supposed to contact my doctor directly because I was told it was illegal to contact the employee regarding fmla? And are they supposed to give me a formal approval of fmla? I've used it for 4 years and until this new manager have never had issues. They all know about my condition because the accident happened right after work and everyone saw it on the news. Any advice would be helpful thanks. "
